Digital Item – Application For Supply and Use

The collection of materials held within the Esperance Museum is referred to as the Esperance Local History Collection. Many of these items were donated by third parties, who donated with agreed conditions of use.

The intended use of this collection is to ensure the retention of local historic items for future use. Every effort has been made to trace copyright holders and gain permission for the use of materials contained in the collection.

The release of material in some instances will be dependent on the Copyright Owner’s Condition of Use. If the intended purpose of the application does not meet these conditions, the items will not be released.

Terms and Conditions of Digital Material Supply

• The creator, title and other information are supplied by the Shire of Esperance Museum in good faith and are not liable for any incorrect information supplied.
• Every effort has been made to trace copyright holders and gain permission for the use of material contained in the collection. Where material is in copyright and the copyright is not held by us, we will inform you and you will need to gain consent from the copyright holder.
• This application is for one use only, non-exclusive, non-transferable usage rights and may not be used for any other purpose without obtaining permission.
• No cropping or editing is permitted, except as reasonably necessary solely for graphic design purposes where the meaning or reading of the material remains unchanged.
• Material to be published electronically, must be at a resolution that is unsuitable for publication-quality printing.
• Payment of invoices must be made in full before the release of the material. Payment will only be accepted in Australian dollars (AUD). Bank transfer fees must be paid by the applicant.
• The Shire of Esperance Museum reserves the right to refuse to supply material or withdraw approval where the context of the image use is deemed to be unsuitable, inappropriate or contrary to the interests of the creator.
• Any use of any material must be acknowledged in the following way:
